Pain Relief Act
Federal Electronic Prescribing of Controlled Substances (EPCS) Requirement and IMPORTANT RULE CHANGES regarding EPCS requirements in New Mexico
Information Needed:
The Department of Health has recently started implementing academic detailing focused on opioid prescribing with their partners UNM and Southwest Care Center. Academic detailing is an innovative, 1-on-1 outreach education technique that helps clinicians provide evidence-based care to their patients. Given busy schedules and competing demands for time, clinicians may not be able to compile the most up-to-date evidence from a continuous influx of research on the comparative effectiveness, safety, and cost of various treatments. In response, trained academic detailers can meet with clinicians to assess individual needs and needs of the practice to offer tailored, evidence-based clinical recommendations.

The Department of Health is seeking information to improve public health practice. This information will be used to tailor education sessions to better support opioid and controlled substance prescribers. They would greatly value your voluntary input and would appreciate if you could take ~8 minutes to complete the survey and forward it along to your colleagues. NEW MEXICO MEDICAL BOARD JOB ANNOUNCEMENT

Prosecutor Position

DESCRIPTION:

The New Mexico Medical Board (Board) is the state agency responsible for the regulation over 10,000 licensees including medical doctors (physicians), physician assistants, anesthesiologist assistants, genetic counselors, polysomnographic technologists, naturopaths and naprapaths. The New Mexico Medical Board is accepting applications to fill the position of Prosecutor. This is an exempt, full-time position based in Santa Fe, NM. This position is responsible for prosecuting physicians and other licensees primarily for violation of the Medical Practices Act specific to unprofessional or dishonorable conduct and/or the Impaired Healthcare Provider Act. The Prosecutor will review most complaints with Board Investigators, will issue recommendations for settlement and will handle adjudications as well as some appeals. Most hearings are held in Santa Fe although they can be held anywhere in the State. The successful candidate will have a strong knowledge of regulatory processes, to include the licensing, disciplining and ensuring compliance of medical professional rules and regulations; and must have a strong knowledge of the state and federal laws/regulations applicable to the medical profession. In addition, the successful candidate must have the ability to provide strong and ethical prosecutorial representation for the Board; possess strong communication, interpersonal and legal skills; exercise sound judgment; and appropriately advise the Boards staff on matters related to the disciplinary processes as it related to the regulation of the medical profession in New Mexico.

QUALIFICATIONS:

Educational requirements: NM Juris Doctorate.

Experience Requirements: 5 or more years of litigation experience. Special emphasis on knowledge of the medical regulation, medical standard of care cases, and/or other professional licensure subject to the ULA is preferred but not mandatory.

Doctor of Osteopathy Criminal Background Check

Required By The NMMB

The Board is requiring a criminal background check be completed as a requirement for licensure. This must be completed by May 31, 2022 for all DO licensees who have not had it completed.

Failure to complete the background check will result in delays in renewals for those licensees renewing by July 1, 2022, and may result in further disciplinary action by the board including, but not limited to, inactivation of license. The background check for the NMMB is required by law and cannot be waived. This requirement is separate and independent of any former background check done for the previous Osteopathic Medical Board.

Below are instructions for obtaining your background check with the company the Board contracts with, GEMALTO. The instructions vary if you reside in the State of New Mexico or if you reside outside of the State of New Mexico. Please ensure you follow the correct instructions provided.

ADDITIONAL URGENT SCAM WARNING FROM THE NEW MEXICO MEDICAL BOARD

Several other scam calls have been reported to the NMMB in February 2020. In these calls, the caller appears to be calling from a NMMB number, 505-476-7220. Although this is our number, these are scam calls; the perpetrators of the scam have successfully cloned the Board's phone number.In this scam, the male callers asked employers for information about specific physicians. If you or your organization receive a phone call from someone claiming to be from the Board, please call our offices immediately before giving out physician (or patient) information.

These scam calls are in addition to letters being sent to practitioners asking for patient information. These letters include what appears to be a replica of the Board's logo.

Pursuant to the Medical Practice Act, specifically, NMSA 1978, §61-6-28, "a licensed physician who changes the location of his [her] office or residence shall promptly notify the board of the change."

Effective November 14, 2019, the Board is assessing $150 in administrative costs to licensees who are found to be non-compliant with this statute.

FRAUD ALERT

18 February 2021

The New Mexico Regulation and Licensing Department has learned of an attempted fraud scheme aimed at licensees. In the scheme, scam artists identify themselves as New Mexico Regulation and Licensing Department staff or investigators and notify the licensee that they are under investigation, that their license may be suspended, or that an arrest warrant has been issued in the licensee’s name, and then they will demand money.

In some instances, scam artists identify themselves as other entities including local police, the Drug Enforcement Agency (DEA) or the Federal Bureau of Investigation (FBI).

The callers may be "spoofing" telephone numbers to make the calls appear to be coming from the New Mexico Regulation and Licensing Department.

NMRLD will never contact licensees demanding money or payment of any form or personalized information without conducting an official investigation or inquiry. If you receive such a call, please refuse the demand for payment.

Please also consider the following:

  • NEVER disclose any personal information, i.e. social security numbers, date of births, or credit/debit card numbers.
  • If you receive a call, contact the New Mexico Regulation and Licensing Department directly at (505) 476-4500 to inquire if an official investigation is being conducted.

If the caller is stating they are from the DEA, you can report the scam using the DEA Extortion Scam Online Reporting Form

If the caller is stating they are from the FBI, you can report the scam using the FBI Internet Crime Complaint Reporting Form

If the phone number of the caller appears to be a New Mexico Regulation and Licensing Department telephone number, you can report the scam using the Federal Communications Commission Consumer Complaint Form
