New Mexico Medical Psilocybin Act: Department of Health Initiates Rulemaking Process
In April 2025, New Mexico Governor Michelle Lujan Grisham signed Senate Bill 219, known as the Medical Psilocybin Act, into law. This legislation establishes a regulated program for the medical use of psilocybin, a naturally occurring psychedelic compound, to treat qualified medical conditions such as major treatment-resistant depression, PTSD, substance use disorders, and end-of-life care. The program is set to be fully implemented by December 31, 2027.
The New Mexico Department of Health (DOH) is now embarking on the critical task of developing the process for implementation of the program. this includes developing the rules and regulations to govern this new program. It also includes establishing treatment protocols, safety guidelines, clinician and producer training requirements, and data collection methods to evaluate the program's effectiveness. A Medical Psilocybin Advisory Board will assist the DOH in these efforts, ensuring that the program is informed by expert guidance.
